1. AGREEMENT AND DEFINITIONS

Welcome to our Terms of Use! This document forms a legal agreement ("Agreement") between you ("User") and Thu Pham ("Provider") governing the use of the mobile application (hereby referred to as "Mobile Application" or "Application"). By accessing or using the Application, you agree to be bound by this Agreement.

The following terms have the meanings defined below:

• Effective Date — the date on which you first access or use the Application.
• User Content — any content, including photos, videos, and music, submitted by you through the Application.
• Mobile Application — the software application provided by the Provider.
• Device — the mobile device used to access the Application.
• Trial Period — a limited period during which Free Services are made available.
• Services — all features and functionality offered through the Application.
• Subscription — a paid plan granting access to premium Services, which renews automatically unless cancelled.
• Subscription Term — the period covered by an active Subscription.
• Subscription Fees — amounts payable for a Subscription.
• Free Term — a period during which the Application is available at no charge.
• Free Services — features available without payment during the Free Term.
• Tariffs — the pricing plans made available by the Provider.

2. SERVICES

Provider grants you a limited, non-exclusive, non-transferable license to use the Application for personal, non-commercial purposes. Services encompass content creation, in-app purchases, and more. Free Services are available during the Free Term, and the Provider may impose technical restrictions and alter functionality at any time.

3. AUTHORIZATION

Provider authorizes your access to and use of the Application upon registration through the applicable app store and provision of any necessary information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. CONTENT

You retain all rights to your User Content and grant the Provider a worldwide, royalty-free license to use, store, and process such content solely for the purpose of providing the Services. You bear full responsibility for the legality of any content you submit. The Provider is not liable for the loss of such content.

5. USER RESTRICTIONS

You must use the Application within legal and contractual limits. You are prohibited from copying, disclosing, or creating unauthorized derivative versions of the Application or its software. Submitting illegal, harmful, or infringing content through the Application is strictly prohibited.

6. PROVIDER'S AND USER'S OBLIGATIONS

The Provider shall use reasonable efforts to ensure the performance and availability of the Services. You agree to pay any applicable Subscription Fees, maintain the security of your account, and comply with all applicable laws and regulations in your use of the Application.

7. TERM AND TERMINATION

This Agreement commences on the Effective Date and continues until terminated. Either party may terminate this Agreement at any time. Upon termination, your access to the Services will cease and, if applicable, you must delete the Application from your device.

8. FEES; PAYMENT TERMS

Subscription Fees are determined by the Tariff selected at the time of purchase. In-app purchases are subject to the terms and management of the applicable app store provider. Subscriptions renew automatically at the end of each Subscription Term unless cancelled prior to renewal.

9. LIABILITY

The Application is provided "as is" and "as available" without warranties of any kind, express or implied. The Provider disclaims all warranties, including fitness for a particular purpose and non-infringement. The Provider bears no responsibility for User Content or for any interruption in availability of the Services. You agree to indemnify and hold harmless the Provider from any claims, damages, or losses arising from your use of the Application.

10. GOVERNING LAW AND JURISDICTION

These Terms of Use are governed by and construed in accordance with the laws of the The Socialist Republic of Vietnam. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of the The Socialist Republic of Vietnam.

11. FINAL PROVISIONS

The Provider and User are independent contractors, and nothing in this Agreement creates a partnership, joint venture, or employment relationship. The Provider reserves the right to perform scheduled or emergency maintenance that may temporarily interrupt access to the Services. These Terms of Use constitute the entire agreement between you and the Provider with respect to the Application and supersede all prior agreements.
